Brief Guide for Joint Petition for Divorce (Uncontested Divorce)

Joint Petition (Mutual Divorce) Process

  1. Consult our divorce lawyer and we will prepare the joint petition for both parties to sign.
  2. Both parties are required to attend the court hearing (1 time only) in the Court or via online hearing (via ZOOM subject to the Court’s discretion).
  3. Get divorce certificate 3 months later after the court hearing.

Single Petition (Non-Mutual Divorce) Process

  1. Go for marriage counselling with the Jabatan Pendaftaran Negara (JPN) first before you can start file a single petition. (Note: This is a MANDATORY step and parties can only be exempted from the counselling with valid reasons)
  2. Consult our divorce lawyer and we will prepare the single petition for signing.
  3. The Court will fix case management and hearing dates
  4. After the court hearing, the Court will grant a divorce order if the Court is satisfied that the marriage has broken down irretrievably.
  5. Get divorce certificate 3 months later after the court hearing.

  1. Your marriage must be registered for more than 2 years under the law before you can file a divorce in Malaysia (may apply divorce within 2 years of marriage with special condition).
  2. Faster and cheaper to file a joint petition for divorce (mutual divorce) compared to a single petition for divorce (non-mutual divorce).
  3. No need to attend counselling (with the JPN Marriage Tribunal) if the divorce is mutual.
  4. Both husband and wife must come to an agreement on all the divorce terms for joint petition.
  5. Terms that must be agreed upon are custody of children, amount of maintenance for wife & children & division of matrimonial assets.
  6. Both parties must sign and attend the Court (divorce hearing) for joint petition.
  7. To file a single petition for divorce, you need to prove reason for the breakdown of marriage. No need reason if the divorce is mutual.
  8. No ‘automatic divorce’ in Malaysia even if both parties are separated for more than 2 years.
  9. In the event if there is no agreement, it is advisable to start with a divorce proposal and our divorce lawyer may assist to negotiate and reach for a settlement to save time and cost for divorce by filing a joint petition.

What are the requirements if I want to file a divorce in Malaysia?

To get a divorce in Malaysia:

  • Your duration of marriage must be more than 2 years (unless there is special circumstances);
  • Marriage must be registered under the Law Reform (Marriage & Divorce) Act 1976 or valid foreign law (provided the marriage must be monogamous); and
  • Both husband and wife must be domiciled in Malaysia (residing permanently in Malaysia).

What are the grounds to file a divorce in Malaysia?

You do not need prove any ground to file a divorce in Malaysia for joint petition for divorce (mutual divorce).

On the other hand, for single petition for divorce (non-mutual divorce), the party filing for divorce must show irretrievable breakdown of the marriage. To establish irretrievable breakdown, the party filing for divorce is required to prove one of the following 4 grounds:

  • Adultery;
  • Unreasonable behaviour;
  • Desertion for 2 years;
  • Separation for 2 years.

Can I get a divorce even if my spouse disagrees to divorce?

You can still get a divorce even if your spouse disagrees by filing a single petition for divorce.

You are required under the law to attend marriage counselling with the Jabatan Pendaftaran Negara (JPN) first before you can file a single petition for divorce in Malaysia.

How long does it take to get divorced in Malaysia?

For joint petition (mutual divorce), it will take less than 6 months generally. In some cases, it can be as quick 1 month.

For single petition (non-mutual divorce), it will take between 6-12 months, or more, if the divorce is disputed and complex.
